29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502: (a)Tim Kapperman Construction at 101 Winterberry Court, Crooks, SD 57020: On or about and at times prior to July 17, 2021, the employer did not ensure employees performing framing activities on a single-family home were protected from fall hazards. Employees were installing roof trusses while standing on the exterior top plate on the second-story of a single-family home without an appropriate fall protection system. This condition exposed employees to an approximate 17 feet 10 inch fall hazard to the exterior of the building. Abatement Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.

29 CFR 1926.502(a)(2): Employer did not provide and install all fall protection systems required by this subpart for an employee, and did not comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection: (a)Tim Kapperman Construction at 101 Winterberry Court, Crooks, SD 57020: On or about and at times prior to July 19, 2021, the employer did not ensure employees performing framing operations on a single-family home were protected from fall hazards. The employer utilized a cross arm anchor strap wrapped around the top chord of a truss and a 2x4 truss stabilizer. Employees connected two rope grab systems to the d-ring of the cross arm strap The manufacturers information associated with the equipment identified that the strap was designed for one worker to be connected at a time. This condition exposed employees to a fall hazard of approximately 17 feet 10 inches due to cross arm strap or anchor failure associated with using two fall protection systems with one strap.
