29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)   a) Lead Building Company, LLC located at buildings 6 & 7, Highpointe Lakes Drive, WESTERVILLE, OH 43081:  On and preceding July 20, 2021,  the controlling employer did not ensure that frequent and regular inspections of the job site, materials and equipment were being conducted by a competent person.  Sub-contractors of all trades were working throughout the site which had visible struck-by and fall hazards present throughout buildings 6 and 7.  The following condition exposed sub-contracted workers to falls exceeding 40 feet from balconies, window openings and scaffolds and struck-by hazards when working on and around scaffolding.

29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)   a) Lead Building Company, LLC located at located at building 6, Highpointe Lakes Drive, WESTERVILLE, OH 43081: On and preceding July 20, 2021, the controlling employer did not ensure that each platform on all working levels of scaffolds were fully planked or decked between the front uprights and the guardrail supports.  A seven tier supported scaffold being utilized by masonry workers was only partially planked utilizing two, 2  x 10" planks between a 36" wide uprights leaving a 15-16" gap unplanked.  The following condition exposed employees to falls in excess of 40 feet.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   a) Lead Building Company , LLC located at located at building 6, Highpointe Lakes Drive, WESTERVILLE, OH 43081: On and preceding July 20, 2021,  the controlling employer did not ensure that employees on scaffolds more than 10 feet above a lower level were protected from falls.   Masonry workers were positioned on the fourth tier of a seven tier scaffold, approximately 25 feet high installing stucco netting on the building.  The fourth tier and other sections of the scaffolding did not have guardrails or other means of fall protection installed which exposed employees to falls in excess of 40 feet at the upper tiers of the scaffolding.

29 CFR  1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section:   a)  Lead Building Company, LLC located at located at building 6, Highpointe Lakes Drive, WESTERVILLE, OH 43081: On and preceding July 20, 2021,  the controlling employer did not ensure that falling object protection to include but not limited to toeboards or barriers around the scaffolding were in place.  A seven tier supported scaffold which wrapped around three sides of the building was being utilized by masonry workers.  No toeboards of other protective measures where in place to ensure that employees on different tiers of the scaffolding or on ground level were protected from falling objects.  The following condition exposed employees to struck-by hazards from tools and materials falling from the scaffolding.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Lead Building Company, LLC located at building 7, Highpointe Lakes Drive, WESTERVILLE, OH 43081:  On and preceding July 20, 2021,  the controlling employer did not ensure that employees performing framing work throughout the building were protected by guardrail systems, safety net system, or personal fall arrest system at all times when they were exposed to falls greater than 6 feet.  Framers were exposed to falls exceeding 40 feet when working on balconies and near unprotected window openings without utilizing any form of fall protection.
