Listed, labeled, or certified equipment shall be installed and used in accordance with instructions included in the listing, labeling, or certification:   a- 8 Coliseum Drive, Eastampton NJ: On or about 07/20/21 a portable electric circular saw, in use by the workers, was powered with a flexible cord that had not been listed, labeled or certified.

29 CFR  1926.405(a)(2)(ii)(J): Extension cord sets used with portable electric tools and appliances shall be of three-wire type and shall be designed for hard or extra-hard usage. Flexible cords used with temporary and portable lights shall be designed for hard or extra-hard usage.   NOTE: The National Electrical Code, ANSI/NFPA 70, in Article 400, Table 400-4, lists various types of flexible cords, some of which are noted as being designed for hard or extra-hard usage. Examples of these types of flexible cords include hard service cord (types S, ST, SO, STO) and junior hard service cord (types SJ, SJO, SJT, SJTO).  (A)  Extension cord sets used with portable electric tools and appliances were not of three-wire type and/or were not designed for hard or extra-hard usage and/or flexible cords used with temporary and portable lights were not designed as required.   a- 8 Coliseum Drive, Eastampton NJ: On or about 07/20/21 a portable electric circular saw, in use by the workers, was powered with a two wire type extension cord.

29 CFR  1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:  a- 8 Coliseum Drive, Eastampton NJ: On or about  07/20/21 portable electric equipment, in use by the workers, were observed being powered with a flexible cord that was not provided with strain relief as result of having been previously damaged.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:  a- 8 Coliseum Drive, Eastampton NJ: Workers, not using fall protection, were exposed to fall hazards up to and in excess of 10 feet 4 inches from the walking/working surface from the ground surface below when performing floor truss installation and other related activities while working/walking from the top plates of a residential structure's wall frames.  Condition observed on or about 07/20/21.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided:  a- 8 Coliseum Drive, Eastampton NJ: Workers were exposed to fall hazards, up to and in excess of 10 feet 4 inches to the floor and ground surface below, when egressing from the top plate of a residential structure's interior and exterior wall frames using 2 x 4s set diagonally on those walls.  Condition observed on or about 07/20/21.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
