29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a)Moore's A-1 Ditching, Inc. at 608 Cleveland Street, Rapid City, SD 57703: On or about and at times prior to July 20, 2021, the employer did not ensure a safe means of egress was located in an excavation over four feet in depth. An employee was working in a trench excavation and not provided with a ladder within 25 feet of the work area. This condition exposed an employee inadequate egress from the trench excavation and cave-in hazards.

29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: (a)Moore's A-1 Ditching, Inc. at 608 Cleveland Street, Rapid City, SD 57703: On or about and at times prior to July 20, 2021, the employer did not ensure that employees were protected from struck-by hazards associated with the collapse of an adjacent sidewalk. The employer undermined the sidewalk by tunneling underneath and not establishing a support system within an eight-foot vertical excavation during a sewer line installation. This condition exposed employees to struck-by hazards associated with the sidewalk collapse.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a)Moore's A-1 Ditching, Inc. at 608 Cleveland Street, Rapid City, SD 57703: On or about and at times prior to July 20, 2021, the employer did not ensure that adequate protection was provided from material falling or rolling into the trench excavation. The spoil pile was less than two feet from the edge of the excavation (along the area of the ladder access to the excavation), which put additional weight and pressure along the face of the vertical wall of the trench exposing an employee to a cave-in hazard. An employee was exposed to the hazard of the spoil pile falling into the excavation while accessing the excavation.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)Moore's A-1 Ditching, Inc. at 608 Cleveland Street, Rapid City SD, 57703: On or about and at times prior to July 20, 2021, the employer failed to ensure employees were protected from struck-by and crushing hazards while working within an excavation greater than five feet in depth without a protective system. On July 20, 2021, an employee accessed a trench excavation measuring 8-foot 3 inches in depth with vertical walls to install a residential sewer line. The employer did not utilize a protective system to ensure employees were protected while working within the trench excavation. This condition exposed employees to struck-by hazards and crushing injuries associated with trench wall cave-in.

29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Moore's A-1 Ditching, Inc. at 608 Cleveland Street, Rapid City, SD 57703: On or about and at times prior to July 20, 2021, the employer did not ensure that daily inspections of a trench excavation, 8-foot 3 inches in depth, 2.5 feet in width, and greater than 25 feet in length, were made by the competent person for evidence of a situation that could have resulted in a hazardous condition. The competent person did not identify that the trench was greater than five feet in depth, had vertical walls, and an unsupported sidewalk. This condition exposed employees to struck-by hazards and crushing injuries associated with trench wall cave-in. Abatement Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
