29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a)Moore's A-1 Ditching, Inc. at 318 Saint Onge Street, Rapid City, SD 57702: On or about and at times prior to September 6, 2022, the employer did not ensure that adequate protection was provided to prevent materials and soil from falling or rolling into the trench excavation in that the spoils pile was less than two feet from the excavation face. This condition exposed employees to struck-by and cave-in hazards.

29 CFR 1926.652(c)(3)(iii): A copy of the tabulated data used to construct the protective system used at the jobsite, identifying the Professional Engineer who approved the data, was not made available upon request: (a)Moore's A-1 Ditching, Inc. at 318 Saint Onge Street, Rapid City, SD 57702: On or about and at times prior to September 6, 2022, the employer did not maintain tabulated data for the Speed Shore protective system constructed and installed on site. This condition exposed employees to struck-by and cave-in hazards associated with improper use of the protective system.
