29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about July 21, 2021, an employee was climbing over the rails of the scissor lift in order to access the third floor of the building under construction, exposing the employee to a fall hazard.

29 CFR 1926.602(d):The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l). On or about July 21, 2021, and at times prior thereto, employees were operating a powered industrial truck without the employer providing training to safely operate the equipment, exposing employees to hazards such as, but not limited to being struck by the powered industrial truck and falling loads.

29 CFR 1926.760(a)(1):Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. On or about July 21, 2021 and at times prior thereto, employees were working on a steel erection site at heights up to approximately 25 feet with out the use of fall protection, exposing the employees to a fall hazard.
