The employer's written hazard communication program was deficient, lacking provision for employee access to safety data sheets for materials used at the jobsite, including but not limited to limestone rock product.

At a construction site located at Journey Church International, 1601 SW State Route 150, Lee's Summit, Missouri 64082, employees were exposed to flying particles of Limestone rock, and crystalline silica dust while dry-cutting stones with a circular saw, on the outside of the building, without wearing any eye protection.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified in Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task in Table 1. (a) At a construction site located at Journey Church International, 1601 SW State Route 50, Lee's Summit, Missouri 64082, employees were exposed to respiratory hazards when dry-cutting stones containing crystalline silica. Workers were observed doing masonry work dry cutting stones on the outside of the building. Employees were cutting the stones for a period of 8 hours per shift, outside and using a hand held saw that did not have the required engineering controls.
