29 CFR 1926.453(a)(2): Aerial lifts were "field modified" for uses other than those intended by the manufacturer; the modification was not certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable provisions of ANSI A92.2 and this section:   a) 1311 East Ave. Erie, PA. On or about July 22, 2021, the Genie aerial lift was field modified to include an extended platform, made from 2x4s and a plywood board, t to lift metal roofing sheets and other tools and equipment onto the roof.

29 CFR 1926.453(b)(2)(v):A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) 1311 East Ave. Erie, PA. On or about July 22, 2021, employees operating and in the basket of the the aerial lift were not using fall protection. Employees are using the aerial lift to access the roof of the industrial building to perform roof repairs. Employees are exposed to fall hazards of 30 feet.

29 CFR  1926.501(c): When an employee is exposed to falling objects, the employer did not implement one of the  measures set forth in (c)(1)-(3) of this section:  a) 1311 East Ave. in Erie, PA. On or about July 22, 2021, falling object protection such as, but not limited to, toeboards, screens, or guardrail systems , was not utilized to protect employees from falling objects.  Employees on the ground were exposed to struck-by hazards from items, including, but not limited to, metal sheeting, tools, and other equipment.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) 1311 East Ave. in Erie, PA. On or about July 22, 2021, employees installing a metal roof on the industrial building, with a 6:12 pitch, are not utilizing any fall protection. Employees working on the roof are exposed to a fall of at least 30 feet.  Danny Miller dba D&A Roofing was previously cited for a Willful Violation of this occupational safety and health standard, or its equivalent standard, 1926.501(b)(13), which was contained in OSHA inspection number 1471227, citation number 1, item number 1B and was affirmed as a final order on April 21, 2020, with respect to a worksite located at 201 W 26th St., Erie, PA 16508.  In addition, Danny Miller dba D&A Roofing was previously cited for a Serious Violation of this occupational safety and health standard, or its equivalent standard, 1926.501(b)(13), which was contained in OSHA inspection number 1471020, citation number 1, item number 3B and was affirmed as a final order on April 20, 2020, with respect to a worksite located at 201 W 26th St., Erie, PA 16508.
