29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems. On or about 7/27/2021, employees from Jeff Kelly Homes Inc. were installing sheathing on the roof of a residence located on lot 48 on Pomodora Circle in Wentzville, MO. They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems. An employee was observed working from the 7/12 pitched roof approximately seventeen feet above the ground without utilizing fall protection. Jeff Kelly Homes Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1525660, citation number 1, item number 1, and was affirmed as a final order on 7/14/2021, with respect to a workplace located at 109 Pomodora Circle in Wentzville, MO.
