29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Jose A. Acosta Pineda, at a jobsite located at 126 Beaman Gates Drive, Lot 251, Granville, Ohio 43023: On and/or preceding July 27, 2021, the employer failed to initiate and maintain a safety and health program such as but not limited to a fall protection program and a ladder safety program for employees conducting framing work.  Jose Pineda was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1501138, citation number 1, item number 1, and was affirmed as a final order on July 2, 2021, with respect to a workplace located at 11535 Poppyseed Dr, Plain City, OH 43064.  Jose Acosta Pineda was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1499312, citation number 1, item number 1A and was affirmed as a final order on February 12, 2021, with respect to a workplace located at 205 Woodland Sky Drive, lot# 91, Pataskala, OH 43062.  Jose A. Acosta Peneda was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1488150, citation number 1, item number 1 and was affirmed as a final order on December 17, 2020, with respect to a workplace located at 184 Old Bay Drive, lot 176,Pataskala, OH 43062.

Acosta Pineda, at a jobsite located at 126 Beaman Gates Drive, Lot 251, Granville, Ohio 43023: On and/or preceding July 27, 2021, the employer failed to train employees on the hazards found on the worksite or the procedures to control or eliminate the hazards for employees conducting framing work.  Jose Pineda was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.21(b)(2), which was contained in OSHA inspection number 1501138, citation number 1, item number 2, and was affirmed as a final order on July 2, 2021, with respect to a workplace located at 11535 Poppyseed Dr, Plain City, OH 43064. Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) Jose A. Acosta Pineda, at a jobsite located at 126 Beaman Gates Drive, Lot 251, Granville, Ohio 43023: On and/or preceding July 27, 2021, the employer did not ensure employees were protected from falls while engaged in residential framing activities. Employees were standing on the second story while exposed to fall hazards of up to 12 feet.  b) Jose A. Acosta Pineda, at a jobsite located at 126 Beaman Gates Drive, Lot 251, Granville, Ohio 43023: On and/or preceding July 27, 2021, the employer did not ensure employees were protected from falls while engaged in residential framing activities. Employees were working near an unguarded basement opening while exposed to fall hazards of up to 10 feet.  Jose Pineda was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1501138, citation number 1, item number 4, and was affirmed as a final order on July 2, 2021, with respect to a workplace located at 11535 Poppyseed Dr, Plain City, OH 43064. 29 CFR  1926.1053(b)(13):The top or top step of a stepladder shall not be used as a step.  a) Jose A. Acosta Pineda, at a jobsite located at 126 Beaman Gates Drive, Lot 251, Granville, Ohio 43023: On and/or preceding July 27, 2021, the employer did not ensure that employees who used ladders did not stand on the top or top step of step ladders. A framer was standing on the top of a 6 foot step ladder, thereby exposing the employee to a six foot fall hazard.  Jose A.
