29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Eldorado Wall Company, Inc. dba Eldorado Climbing, 1699 Cherry St., Unit B, Louisville, CO  80027:  On and before July 27, 2021, a shaper operator was exposed to a dose of 92.6% (8-hour time weighted average of 90.4dBA) for a 423 minute sampling.  The employer did not administer a continuing, effective hearing conservation program to include noise monitoring, audiometric testing, employee notification, use of appropriate hearing protection, administration of pertinent training and education, and associated recordkeeping.  This condition exposed an employee to a hearing loss hazard.

29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Eldorado Wall Company, Inc. dba Eldorado Climbing, 1699 Cherry St., Unit B, Louisville, CO  80027:  On and before July 27, 2021, the employer did not provide a comprehensive and compliant written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures. The program was missing provisions for fit testing for required use, respirator storage, and training.  The employer required respirator use for some tasks and permitted voluntary use for other tasks. This condition exposed employees to respiratory hazards.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   a) Eldorado Wall Company, Inc. dba Eldorado Climbing, 1699 Cherry St., Unit B, Louisville, CO  80027:  On and before July 27, 2021, the employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employees were required to use the respirator in the workplace. Employees were required to wear 3M model full-facemask and half-facemask air purifying respirators with P100 filters when painting. This condition exposed employees to physiological stress hazards.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  a) Eldorado Wall Company, Inc. dba Eldorado Climbing, 1699 Cherry St., Unit B, Louisville, CO  80027:  On and before July 27, 2021, the employer did not develop, implement, and maintain in the main building, a compliant written hazard communication program for work at this facility which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met. Employees were assigned to work with hazardous chemicals including but not limited to:   1) Sherwin Williams - Waterbased Acrolon 100 HS (sensitizer and toxic) 2) Sherwin Williams - Waterbased Acrolon 100 HS Hardener (toxic) 3) Sherwin Williams - Armorseal Tread Plex (irritant and toxic)  4) Rustoleum - Professional High Protective Enamel Oil Based (flammable and toxic) 5) Rustoleum - Painters Touch Paint and Primer (flammable and toxic) 6) Glidden - Premium Interior Paint Plus Primer (flammable and toxic) 7) WD-40 Aerosol (flammable, toxic and gas under pressure) 8) Titebond - Titebond III Ultimate Wood Glue (flammable and irritant) 9) Bondo - All Purpose Putty (flammable, toxic, and irritant) 10) DAP - Plastic Wood All Purpose Wood Filler (flammable, toxic, and irritant)  This condition exposed employees to chemical exposure hazards.

Employees did not receive training on hazardous paints, wood fillers and aerosols containing hazardous health and physical characteristics.  This condition exposed employees to chemical exposure hazards.

Employees conducted welding and wood cutting operations. This condition exposed these employees to respiratory hazards.
