29 CFR  1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  On or about 7/28/2021, employees from Tuepker Brothers Construction LTD. were framing a roof of a pavilion located at the intersection of Leather Reins Drive and Tall Timber Drive in Wentzville, MO.  An employee was not wearing a protective helmet while working beneath the foreman as he framed a hip roof.  The exposed employee was cutting and handing materials to the foreman while standing directly below him.

29 CFR  1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  On or about 7/28/2021, employees from Tuepker Brothers Construction LTD. were framing a roof of a pavilion located at the intersection of Leather Reins Drive and Tall Timber Drive in Wentzville, MO. The foreman was using a portable ladder to access the trusses.  The ladder was not long enough to access the trusses safely and did not extend three feet above the bottom chord or upper landing surface.

29 CFR  1926.501(b)(11):  "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  On or about 7/28/2021, employees from Tuepker Brothers Construction LTD. were framing a roof of a pavilion located at the intersection of Leather Reins Drive and Tall Timber Drive in Wentzville, MO. The foreman was observed framing a 5/12 sloped roof, approximately seventeen feet above the ground, without utilizing fall protection.  Tuepker Brothers Construction LTD. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1365736, citation number 1, item number 1 and was affirmed as a final order on 1/29/2019, with respect to a workplace located at1306 Sunview Drive in O'Fallon, MO.

An employee was not utilizing eye protection while using circular saw to cut lumber.
