29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about July 28, 2021, during the re-installation of (2) mini-split air conditioners on the roof of Brecksville-Broadview Heights Middle school, located at 6380 Mill Road, Broadview Heights, OH 44147; the employer did not ensure employees engaged in that HVAC work utilized fall protection while being exposed to a fall approximately 13.6 to the lower level ground level.
