29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   The employer did not protect each employee from the hazard of falling by the use of  fall protection systems.  This most recent event occurred on July 30, 2021 at 717 Fife Ct, the Fischer Homes Lot NST 402, Sunbury, OH 43074.  The employer failed to ensure an employee performing framing work from the roof was protected from falls..  Garcia Builders, LLC was was previously cited for a willful violation Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1508038, citation number 2, item number 3 and was affirmed as a final order on March 15, 2021, with respect to a workplace located at 3628 Switchgrass Ct, Lot #255, Hilliard, OH 43026.  Garcia Builders, LLC was previously cited for a repeat serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1501008, citation number 2, item number 2 and was affirmed as a final order on December 31, 2020, with respect to a workplace located at 11618 Orchard Hills Drive, Lot JEV 047, Plain City, OH 430644.  Garcia Builders, LLC was previously cited for a repeat serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1498755, citation number 2, item number 2 and was affirmed as a final order on December 15, 2020, with respect to a workplace located at 6097 Honey Farm Way, Lot FRM009, Grove City, OH 43123.  Garcia Builders, LLC was previously cited for a repeat serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1477510, citation number 1, item number 2 and was affirmed as a final order on July 15, 2020, with respect to a workplace located at 3603 Switchgrass Court, Lot HER247, Hilliard, OH 43026.  Garcia Builders, LLC was previously cited for a repeat serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1333312, citation number 2, item number 2 and was affirmed as a final order on September 4, 2018, with respect to a workplace located at 5681 Marshview Drive, Hilliard, OH 43026.  Garcia Builders, LLC was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1261763, citation number 1, item number 1 and was affirmed as a final order on November 14, 2017, with respect to a workplace located at 1715 Gingerfield Way, Sunbury, OH 43074.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.
