29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Luis Torres dba Torres Roofing at 4944 Jericho Way in Rapid City, SD 57702: On or about and at times prior to June 2, 2021, the exposing employer did not ensure employees were protected from fall hazard in that employees performing roofing activities were not ensured to be protected from fall hazards of 7-9' by use of an appropriate fall protection system. This condition exposed employees to fall hazards of approximately 7-9 feet. b) Luis Torres dba Torres Roofing at 4934 Jericho Way in Rapid City, SD 57702: On or about and at times prior to June 2, 2021, the exposing employer did not ensure employees were protected from fall hazard in that employees performing roofing activities were not ensured to be protected from fall hazards of 7-9' by use of an appropriate fall protection system. This condition exposed employees to fall hazards of approximately 7-9 feet. c) Luis Torres dba Torres Roofing at 4924 Jericho Way in Rapid City, SD 57702: On or about and at times prior to June 2, 2021, the exposing employer did not ensure employees were protected from fall hazard in that employees performing roofing activities were not ensured to be protected from fall hazards of 7-9' by use of an appropriate fall protection system. 29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Luis Torres dba Torres Roofing at 4924 Jericho Way in Rapid City, SD 57702: On or about and at times prior to June 2, 2021, the exposing employer did not ensure employees were protected from fall hazard in that a ladder used to access and egress the roof was not extended at least three feet above the roof eave. This condition exposed employees to fall hazards of approximately 7-9 feet. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
