29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the Retread Area, on or about August 6, 2021 - The employer did not administer a hearing conservation program which included an audiometric testing program and the opportunity to select hearing protectors from a variety of suitable hearing protectors when an employee's noise exposure exceeded a dose of fifty percent. A Retread Laborer was exposed to noise at an 8-hour time-weighted average sound level of 89.08 dBA, or, equivalently, a dose of 88.05% during a 448 minute sampling period on August 24, 2021 while skiving and repairing tires in the Retread Area. b) In the Retread Area, on or about August 6, 2021 - The employer did not administer a hearing conservation program which included an audiometric testing program and the opportunity to select hearing protectors from a variety of suitable hearing protectors when an employee's noise exposure exceeded a dose of fifty percent. A Retread Manager was exposed to noise at an 8-hour time-weighted average sound level of 90.94 dBA, or, equivalently, a dose of 113.9% during a 426 minute sampling period on August 24, 2021 while repairing and buffing tires in the Retread Area. c) In the Retread Area, on or about August 6, 2021 - The employer did not administer a hearing conservation program which included an audiometric testing program and the opportunity to select hearing protectors from a variety of suitable hearing protectors when an employee's noise exposure exceeded a dose of fifty percent. A Retread Laborer was exposed to noise at an 8-hour time-weighted average sound level of 87.96 dBA, or, equivalently, a dose of 75.40% during a 452 minute sampling period on August 24, 2021 while buffing tires in the Retread Area.

The Retread Laborer was only able to select Moldex Pura-Fit ear plugs as their hearing protector. b) In the Retread Area, on or about August 6, 2021 - The employer did not give a Retread Manager the opportunity to select hearing protectors from a variety of suitable hearing protectors when the Retread Manager's noise exposure exceeded a dose of fifty percent. The Retread Manager was only able to select Moldex Pura-Fit ear plugs as their hearing protector. c) In the Retread Area, on or about August 6, 2021 - The employer did not give a Retread Laborer the opportunity to select hearing protectors from a variety of suitable hearing protectors when the Retread Laborer's noise exposure exceeded a dose of fifty percent.
