OSH ACT of 1970 Section (5)(a)(1)  Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were potentially exposed to fall hazards from railings that were too low:  A.)  E.E. Austin & Son, Inc., 5343 Station Road, Erie, PA  16563, on or about August 5, 2021 and times prior thereto/South Deck Area: Employees were exposed to a fall height of at least 6-feet  while walking and working in the deck area.  The wire rope guardrail systems was not tall enough in that the top rail was positioned between 33-inches and 35-inches above the walking/working surface.

Austin & Son, Inc., on or about May 20, 2021 and times prior thereto:  The employer did not fill in the information regarding the establishment name, city, and state on the 2021 OSHA 300 form.  B.)  E.E. Austin & Son, Inc., on or about May 20, 2021 and times prior thereto:  Column F for Case #1 on the 2021 OSHA Form 300 Injury and Illness Log provided the injury and part of the body affected, but did not include the object / substance that directly injured the person.  C.)  E.E. Austin & Son, Inc., on or about June 30, 2021 and times prior thereto:  Column F for Case #2 on the 2021 OSHA Form 300 Injury and Illness Log provided the object / substance that directly injured the person and the part of the body affected, but did not include a description of the injury. E.E. Austin & Son, Inc., 5343 Station Road, Erie, PA  16563, on or about August 5, 2021 and times prior thereto:  Employees were utilizing chemicals including, but not limited to, OSI Quad Premium Professional Sealant.  The safety data sheet for the chemical was not available at the job site. 29 CFR 1926.150(a)(4):  All firefighting equipment was not periodically inspected and maintained in operating condition, and the defective equipment was not immediately replaced:  A.)  E.E. Austin & Son, Inc., 5343 Station Road, Erie, PA  16563, on or about August 5, 2021 and times prior thereto:  Employees were provided with, and permitted to use, a Kidde ABC portable multi-purpose dry chemical fire extinguisher (S/N:  M-183221).  The pressure gauge indicator for the fire extinguisher was in the recharge position.  B.)  E.E. Austin & Son, Inc., 5343 Station Road, Erie, PA  16563, on or about August 5, 2021 and times prior thereto:  Employees were provided with, and permitted to use, a Kidde ABC portable multi-purpose dry chemical fire extinguisher (S/N:  M-183221).  The fire extinguisher received its last annual maintenance in February 2020.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

The wire rope guardrail systems was not flagged at 6-foot intervals.  The flags were at least 10-feet apart.
