29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: At a worksite located at 242 River Rock Rd, Ozark MO: Employees were exposed to health hazards in the form of silica. This was demonstrated on or about August 12, 2021, and at times prior to when employees were exposed to respiratory hazards when employees were dry-cutting stone countertops. Wet methods or dust/vacuum collection systems with high-efficiency particulate air (HEPA) filters were not in use. Employees were exposed to respiratory hazards from the accumulation of dust when the vacuums systems or wet methods were not utilized during the course of the project.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103): At a worksite located at 242 River Rock Rd, Ozark MO: Employees were exposed to health hazards in that they may be harmed by the use of a respirator. This was demonstrated on or about August 13, 2021, and at times prior to, when employees were exposed to respiratory hazards when employees were directed to use a tight-fitting elastomeric respirator while dry cutting stone countertops. The employer's respiratory protection program failed to establish and implement all provisions for required respirator use. The program did not include any procedures for proper use of a respirator during routine and emergency situations.
