29 CFR 1910.30(a)(1):29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard. And/or the employer did not ensure employees are trained in the requirements of this paragraph on or before May 17, 2017; On or about August 16, 2021 the employer failed to ensure that employees tasked with the use of employer supplied PFAS and other fall protection devices were trained on such prior to their use. The employer provides powered industrial elevated order pickers as well as a manufactured steel man baskets (fork mounted) for use in reaching racking systems. The employer requires the use of PFAS when these are utilized however has not trained employees in fall protection.

29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: On or about August 16, 2021 the employer failed to ensure that the utilization of a steel manufactured man basket was approved for use by the manufacturer of the powered industrial fork trucks on site. The employer purchased the basket for use in elevating employees for access to higher racking systems.
