29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: A.) Rupe Industries, LLC dba Johnson Industries Pallets, 6774 Orangeville Road, Sharpsville, PA 16150, on or about April 7, 2021 and times prior thereto: Employees are performing service and maintenance on equipment including, but not limited to, the Baker Band Saw. The company did not have an energy control program including, but not limited to, energy control procedures, employee authorized training, employee affected training, and periodic inspections. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): A.) Rupe Industries, LLC dba Johnson Industries Pallets, 6774 Orangeville Road, Sharpsville, PA 16150, on or about April 7, 2021 and times prior thereto: Employees are performing service and maintenance on equipment including, but not limited to, the Baker Band Saw. Employees were not performing sequential techniques necessary for the control of hazardous energy including, but not limited to, operating the energy isolation devices, and the applicating the lockout device to the energy isolation device. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

Rupe Industries, LLC dba Johnson Industries Pallets, 6774 Orangeville Road, Sharpsville, PA 16150, on or about April 7, 2021 and times prior thereto: Employees were working within proximity to a remotely operated Baker rotary chop saw. Access points to the saw area were not equipped with safety instruction signage or other means to restricting access to the area. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).
