29 CFR  1910.1200(e)(1):  The standard is applicable to construction employment as referenced by 1926.59 The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  The employer is failing to protect employees from hazardous chemicals by not having a written hazardous communication program - This was most recently documented on or about August 17th 2021 at 1911 Hildt Street in Elkhorn, Nebraska. The employer has failed to protect their employees from health hazards by not developing a written comprehensive hazard communication program. Hazardous chemicals used at the jobsite included Vulkem sealant.

Chemical manufacturers and importers did not obtain or develop a safety data sheet for each hazardous chemical and for each chemical that posed a hazard not otherwise classified that they produce or import.     The employer is failing to protect employees from hazardous chemicals by not maintaining the required safety data sheets for the hazardous chemical that was being used in the workplace.  This was most recently documented on or about August 17th 2021 at 2911 Hildy Street in Omaha, Nebraska.  The hazardous chemical used at the jobsite included vulkem sealant that was used for conducting roofing activities.

29 CFR  1910.1200(h)(1): The standard is applicable to construction employment as referenced by 1926.59   Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  The employer is failing to protect employees from hazardous chemicals by not providing employees with effective information and training on the hazardous chemical used in the workplace - This was most recently documented on or about August 17th, 2021 at 2911 Hildy Street in Elkhorn, Nebraska.  The hazardous chemical that was used at the jobsite was vulkum sealant.

The employer is failing to protect employees from fall hazards associated with roofing operations where the ground to the top of the eave was greater than 6 ft. The most recent occurrence of this was evident during the inspection of the job site located at 2911 Hildy Street, Elkhorn,  NE 68022 - The employer had 2 employees standing on the roof without using any fall protection.

The employer is failing to protect employees from fall hazards associated with roofing operations on new residential home located at 2911 Hildy Street, Elkhorn,  NE 68022; An extension ladder was used for access and egress to the roof and it did not extend at least 3 feet above the surface being accessed. Also, the ladder was also not secured at its top to a rigid support.

29 CFR  1926.1053(b)(9):The area around the top and/or bottom of (a) ladder(s) was not kept clear:  The employer is failing to protect employees from slips, trips, and fall  hazards associated with roofing operations on new residential home located at 2911 Hildy Street , Omaha, NE  68022.  The area around the bottom of the ladder that was used for access/egress to the roof was surrounded by various types of debris that included:  Loose paper, extension cords, shingles, and water bottles.   Exposing employees to these hazards could result serious injuries such as broken bones, lacerations, head trauma.
