29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about September 2, 2021, three employees were using pneumatic nail guns to install shingles without wearing appropriate eye protection, exposing the employees to the hazard of being struck in the eye(s) by flying debris or projectiles.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. On or about September 2, 2021 and at times prior thereto, four employees were installing shingles on the roof of the residential home under construction without the employer providing fall protection training, exposing employees to a fall hazard.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about September 2, 2021, employees accessed the roof of a one-story home by using a portable ladder that was not extended at least 3 feet above the upper landing surface, exposing the roofers to a fall hazard of approximately 10 feet to the ground below.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about September 2, 2021, and at times prior thereto, three employees were installing shingles to the roof of the residential home under new construction up to approximately 18 feet high without fall protection, exposing the employees to a fall hazard. The Gerardo Chavez Gonzales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1516753, citation number 1, item number 1 and was affirmed as a final order on April 26, 2021, with respect to a workplace located at 19642 San Angelo Park Drivenull Cypress, TX 77433.
