29 CFR 1926.451(e)(1):  Portable ladder, hook-on ladder, attachable ladder, stair tower, stairway-type ladder, ramp, runway, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used to access scaffold platforms more than 2 feet above or below a point of access:   a)  On September 8, 2021, employees were exposed to a fall hazards while accessing and egressing scaffold work platforms.  No abatement certification or documentation is required for this item.

29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  a)  On September 8, 2021, employees working from frame scaffolding were exposed to fall hazards of greater than 25 feet.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a)  On September 8, 2021, employees performing masonry work were exposed to fall hazards of 4 stories.  J H Spell & Associates LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1) which was contained in OSHA inspection number 1530387, citation 1, item 2a, and was affirmed final order on June 22, 2021, with respect to a workplace located at 3253 N Elston Ave, Chicago, IL 60618.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
