29 CFR  1926.102(a)(1):29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  Nonato Construction Enterprise, LLC at the address of 3808 Venice Rd. in Sandusky, OH:  On or about September 15, 2021, the employer did not ensure that employees operating the nail gun or circular saw during roofing work wore eye protection to protect from flying object hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Nonato Construction Enterprise, LLC at the address of 3808 Venice Rd. in Sandusky, OH:  On or about September 15, 2021, the employer did not ensure employees were protected from falls of approximately nine feet while performing roofing work on a residential structure.   Nonato Construction Enterprise, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1272803, citation number 1, item number 1, and was affirmed as a final order on January 5, 2018, with respect to a workplace located at 11318 Trenton Rd., Galena, OH 43021.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
