29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about April 16, 2024, the employer Nonato Construction Enterprise, LLC at jobsite located at 152/154 E. Township Rd. 1178 Tiffin OH 44883, did not ensure that employees were protected from head injury hazards by protective hardhats while working directly below overhead roofing work, including shingle tear off using hand tools and shovels. Two employees were exposed to struck-by hazards in that they were working on the ground level cleaning up, and raking up torn off shingles, directly under ongoing overhead roofing work.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about April 16, 2024, the employer Nonato Construction Enterprise, LLC at jobsite located at 152/154 E. Township Rd. 1178 Tiffin OH 44883, did not ensure employees were protected from falls while performing residential existing construction roofing activities atop a 4:12 pitch sloped residential second level roof deck. Nine employees were exposed to falls of 10 feet or greater from the eaves to the ground below.  Nonato Construction Enterprise, LLC was previously cited for a violation of an equivalent Occupational Safety and Health standard 1926.501(b)(13) which was contained in OSHA inspection number 1553471 citation number 2, item number 1 and was affirmed as a final order on November 16, 2021 with respect to a workplace located at 3808 Venice Rd., Sandusky, OH 44870.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:  On or about April 16, 2024, the employer Nonato Construction Enterprise, LLC at jobsite located at 152/154 E. Township Rd. 1178 Tiffin OH 44883, did not provide a training program for each employee potentially exposed to fall hazards while using a portable multi-function ladder to enable each employee to recognize the hazards of falling from the ladder and the procedures to be followed in order to minimize these hazards. Twelve employees were exposed to falls from approximately 10 feet or greater while using a Louisville brand extension ladder to perform residential roofing construction activities.
