29 CFR 1915.73(d):When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1) and (2): (a) Coastal Navigator located on the floating dry dock at Dakota Creek Industries Shipyard; On or about September 15, 2021 and 3 days prior, employees who were needle gunning paint off the main deck guardrails and deck floor were exposed to improperly guarded sections of the deck, exposing them to a fall of approximately 30-40 feet to the drydock floor. Parts of the permanent metal deck guardrails were removed, which were approximately 10 feet wide and yellow chains were added, however employees could potential fall through the openings in the yellow chains to the dry dock floor. One opening on the port side of the ship had a top yellow chain rail that measured 33 inches high from the deck floor and the bottom yellow chain rail measured 5 inches high from the deck floor. Another opening on the port side of the ship had a top yellow chain rail that measured 34 inches high from the deck floor and the bottom yellow chain rail measured 6 inches high from the deck floor. An opening on the starboard side of the ship had a top rail that measured 31.5 inches high from the deck floor and the bottom rail measured 6.5 inches high from the deck floor.
