29 CFR  1910.28(b)(3)(i):  The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):  Roof:  On, or about, September 20, 2021, an employee was exposed to potential fall hazards while accompanying a HVAC contractor who was performing preventive maintenance on roof mounted equipment.  The company had provided free-standing railings or skylight screens for only some of the skylight openings on the roof, leaving the majority of the skylights unprotected.

29 CFR  1910.146(c)(3):  When the employer decided that its employees would not enter permit spaces, the employer did not comply with 29 CFR 1910.146(c)(1), 29 CFR 1910.146(c)(2), 29 CFR 1910.146(c)(6), and 29 CFR 1910.146(c)(8):  Company:  On, or about, November 9, 2021, the employer had not conducted an assessment to identify permit required confined spaces, had not marked permit required confined spaces and had not developed a program to inform contractors of the hazards associated with confined spaces.  In addition, the employees of the company accompanied contractors who worked in confined spaces and assisted with removing/replacing covers to facilitate work in confined spaces.

Equipment in the facility included, but was not limited to, hydraulic lifts, bus washing equipment, HVAC units, boilers, dust collection equipment, spray finishing equipment, drainage/sewage collection pits with associated pumps/piping, metal working equipment and abrasive blasting equipment.

Bay 41:  On, or about, September 16, 2021, Machine 11, a Baldor pedestal grinder, was anchored to the floor in front of the Furnas control box provided for the dust collection system.  B. 29 CFR  1910.303(g)(1)(ii):  The required working space about electric equipment rated 600 volts, nominal, or less to ground, was used for storage:  On, or about, September 16, 2021, items were stored in front of electrical equipment in the following areas:  A.	Body Shop:  Vehicle components were stored in front of the disconnect for the sandblaster.  B.	Mechanic Bays:  A rolling tool box was stored in the working space of the Westinghouse motor control center, MCC-MSP-9.  Also, a hose and electrical cord were hanging from the right side and a battery charging shelf had been installed on the left side of the enclosure.  C.	Fabrication Shop:  Two MIG welders were stored in front of the disconnect for the drill press receptacle.  D.	Generator Room (M148):  Throughout the room, items such as, but not limited to, portable lights, boxes, a wet/dry vacuum, a ladder, a conduit bender, a chair and plastic saw horses were stored in front of electrical panels.
