29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) On or about September 22, 2021, the employer failed to ensure that effective machine guarding was in place to protect employees from point of operation on the Parry Mitering Machine #1239WR. Employees were able to reach into the point of operation where the downward motion of the blade meets material being cut for production pieces. b) On or about September 28, 2021, the employer failed to ensure that effective machine guarding was in place to protect employees from point of operation on the Parry Mitering Machine #1259. Employees were able to reach into the point of operation where the downward motion of the blade meets material being cut for production pieces. c) On or about September 28, 2021, the employer failed to ensure that effective machine guarding was in place to protect employees from the rotation and pinch point of the flywheel on the Parry Mitering Machine #1239WR. Covers and guarding were not present on the operator side (front) of the equipment to prevent employees from reaching into the hazardous area. d) On or about September 28, 2021, the employer failed to ensure that effective machine guarding was in place to protect employees from the rotation and pinch point of the flywheel on the Parry Mitering Machine #1259. Covers and guarding were not present on the operator side (front) of the equipment to prevent employees from reaching into the hazardous area. The Tap Packaging Solutions was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1199639, citation number 1, item number 1 and was affirmed as a final order on February 16, 2017, with respect to a workplace located at 2160 Superior Ave E., Cleveland, OH 44114.
