OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to fall hazards from a moving all-terrain vehicle.  On or about September 23, 2021, employees were assigned to operate a Type I single-rider 2014 Honda TRX500 Foreman ATV (serial number 1HFTE44D1E4000937)  for transportation and towing tasks.  The employer did not prevent employees' exposure to fall hazards when riding together as the operator and a passenger.  Safe use and operating practices were not followed and the vehicle's suspension parts were unsafely modified.  Abatement documentation is required for this item in accordance with the requirements of 29CFR 1903.19(d).

29 CFR  1910.132(a):Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  On or before September 23, 2021, the employer did not provide personal protective equipment (PPE) such as, but not limited to, chemical resistant gloves and ATV helmets to employees exposed to skin absorption of harmful substances and head injuries while moving and servicing ATVs and boats.

If such hazards are present, or likely to be present, the employer shall:  On or before September 23, 2021, the employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE) such as, but not limited to, steel toed shoes, chemical resistant gloves, and ATV helmets.  Employees are exposed to foot injuries from falling or rolling objects, skin absorption of harmful substances, and head injuries while moving and servicing ATVs and boats.

29 CFR  1910.136(a):General requirements. The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures.  On or before September 23, 2021, the employer did not ensure that employees used protective footwear while working in areas where they were exposed to falling or rolling objects.  Employees working in the service department were not protected from suffering crushing injuries from the wheels of boat trailers that were being moved in and out of the service area by a PIV or an ATV.
