OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to struck-by and crushing hazards:  a) Sooner, Inc. DBA TerraTech Services at 21348 HWY 6 & 24 in Rifle, CO 81650: On or about 9/28/2021, the employer did not ensure that workers stayed clear of an unsecured load. An employee was fatally injured during flatbed trailer pipe loading operations. A pipe rolled off of the trailer, struck the worker knocking him to the ground, and then fell on the worker.   Abatement Note: Among other methods, feasible and acceptable abatement methods to correct this hazard include the following:  1. Forbidding workers on foot from working near flatbeds during loading operations.  2. Installing steel uprights tall enough and of sufficient construction to prevent shifting pipes from rolling off of the trailer; and  3. Comply with DOT regulation 49 CFR 393.106(b) which states " General. Cargo must be firmly immobilized or secured on or within a vehicle by structures of adequate strength, dunnage or dunnage bags, shoring bars, tiedowns or a combination of these."
