29 CFR 1910.95(k)(1): The employer did not train each employee who was exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: On or about October 07, 2021, the employer did not institute a training program for employees exposed to noise exceeding 85 dBA (as an 8 hour time-weighted average). An employee operating a Pittsburgh pneumatic hammer was exposed to 87.9 dBA, as an eight hour time weighted average. The employee was sampled on October 07, 2021 and was sampled for 7 hours and 51 minutes, the remaining 9 minutes was calculated as 0 (zero) exposure time.

29 CFR 1904.41(a)(1):29 CFR 1904.41(a)(1) If your establishment had 250 or more employees at any time during the previous calendar year, and this part requires your establishment to keep records, then you must electronically submit information from the three recordkeeping forms that you keep under this part (OSHA Form 300A Summary of Work-Related Injuries and Illnesses, OSHA Form 300 Log of Work-Related Injuries and Illnesses, and OSHA Form 301 Injury and Illness Incident Report) to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the forms. On or about March 02, 2022 the employer failed to electronically submit their 300A Summary of Work-Related Injuries and Illnesses to OSHA for the calendar year 2021.
