OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees working near and indoor dust collectors handling combustible wood dust generated by several upstream processes were exposed to wood dust fire hazards presented by the indoor dust collection systems and its associated upstream equipment: On or about October 20, 2021, at a facility located at N3151 State Road 47, Appleton, WI 54913; an indoor cartridge filter media dust collector (Northtech, Model NT-DC2500RAL-ACS, S/N 072808) with positive pressure air-material inlet and three cartridge media filters was used to collect combustible wood dust fines from a wide belt sanding machine (Butfering Model SWT 134 RRC, S/N 0411492649). The dust collector was used to collect wood dust from equipment recognized as being capable of producing frequent sparks and was located near normally occupied areas. Employees were exposed to combustible wood dust hazards including flames and hazardous byproducts (smoke, toxic gases, etc.) resulting from this indoor collection system setup.
