On or about 10/19/2021, Texas Building Systems, Inc. was framing the fourth floor of a residential building located at 1135 Technology Drive in O Fallon, MO. An employee was using a pneumatic nail gun without wearing eye protection.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems. On or about 10/19/2021, Texas Building Systems, Inc. was framing the fourth floor of a residential building located at 1135 Technology Drive in O Fallon, MO. They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems. The foreman and several employees were exposed to the following hazardous conditions: a) An employee was walking on the top plate of the fourth floor near the exterior wall, approximately thirty-five feet above the ground, without utilizing fall protection; b) An employee was using a nail gun near the unprotected edge or floor near the exterior wall on the fourth floor without utilizing fall protection; c) And, four employees were loading a site made container raised to the edge of the fourth floor. They were utilizing fall protection while walking near the unprotected edge or while loading the container.
