29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with 29 CFR 1910.147(c)(4):  (a)P & M Steel Company at 4401 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to October 19, 2021, the employer did not ensure a program was established consisting of energy control procedures and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative, including but not limited to the PythonX2, Avenger 11, and 833A Anglemaster.   Abatement Note:  As part of an energy-control program, employers must:  (1)Establish energy-control procedures for removing the energy supply from machines and for putting appropriate lockout or tagout devices on the energy-isolating devices to prevent unexpected re-energization.  When appropriate, the procedure also must address stored or potentially re-accumulated energy.  (2)Train employees on the energy-control program, including the safe application, use, and removal of energy controls; and  (3)Inspect these procedures periodically (at least annually) to ensure that they are being followed and that they remain effective in preventing employee exposure to hazardous energy.  The energy-control procedures must outline the scope, purpose, authorization, rules, and techniques that employees will use to control hazardous energy sources, as well as the means that will be used to enforce compliance.  These procedures must provide employees at least the following information:  (1)A statement on how to use the procedures;  (2)Specific procedural steps to shut down, isolate, block, and secure machines;  (3)Specific steps designating the safe placement, removal, and transfer of lockout/tagout devices and identifying who has responsibility for the lockout/tagout devices; and  (4)Specific requirements for testing machines to determine and verify the effectiveness of lockout devices, tagout devices, and other energy-control measures.

29 CFR  1910.179(j)(2)(iv):Monthly inspections of hoist chains, with a certification record which includes the date of inspection, the signature of the person who performed the inspection and an identifier of the chain which was inspected, were not performed:  (a) P & M Steel Company at 4401 South Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to October 19, 2021, the employer did not ensure that monthly inspections of hoist chains, with signed reports, were performed.  Employees used multiple cranes and hoists, including a 3 ton Yale and a 10 ton Superior outside bridge crane, to transport fabricated steel components in and about the production floor.  The employer did not ensure that the monthly inspections of hoist chains and ropes were documented.  This condition exposed employees to a struck by hazard.

29 CFR  1910.179(j)(3):A complete periodic inspection of cranes had not been conducted in the past 12 months:  (a)P & M Steel Company at 4401 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to October 19, 2021, the employer did not ensure that a complete periodic inspection of all cranes had been conducted in the past 12 months, such as but not limited to the 19 separate overhead gantry style cranes in use on the property.  This condition exposed employees to a crushing and amputation hazard.

29 CFR  1910.212(a)(1):One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.   (a)P & M Steel Company at 4401 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to October 19, 2021, the employer did not ensure that the unused portion of blade on the vertical bandsaw,  Marvell Series 25, Ser#825651-W was protected with a guard or shield.  Approximately 10 inches of saw blade was exposed while cutting one inch square stock.  This condition exposed employees to an amputation hazard.  (b)P & M Steel Company at 4401 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to October 19, 2021, the employer did not ensure that the rebar roller machine, unknown manufacturer,  was equipped with a guard or other protective mechanism to protect the operator from the ingoing nip point.  This condition exposed operators to crushing hazards.  (c)P & M Steel Company at 4401 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to October 19, 2021, the employer did not ensure that the rebar bender, E.G. Heller's Son, Model 6-36, was equipped with guards or otherwise protected from operator contact to the ingoing nip point.   This condition exposed operators to crushing and amputation hazards.

29 CFR  1910.252(b)(2)(iii):Workers and other persons adjacent to the welding area were not protected from the arc rays by noncombustible or flameproof screens or shields:  a)P & M Steel Company at 4401 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to October 19, 2021, the employer did not ensure workers and other persons walking adjacent to the PythonX robotic MIG welder  were protected from the infrared light by welding screens.  This condition potentially exposes employees to injurious light radiation.
