29 CFR 1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) On October 19, 2021, at the above addressed jobsite, employees were exposed to a struck-by hazard from falling lumber, tools, and debris when working below employees and material. The employees were not wearing hard hats. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) On October 19, 2021, at the above addressed jobsite, employees performing carpentry work on a roof of a residential home were approximately 20 feet above the ground and were not provided personal fall arrest systems or other means of fall protection, thereby exposing the employee to fall hazards. b) On October 19, 2021, at the above addressed jobsite, employees performing carpentry work on a roof of a residential home were approximately 30 feet above the ground and were not provided personal fall arrest systems or other means of fall protection, thereby exposing the employee to fall hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. DD Carpentry Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1454247, citation number 2, item number 1 and was affirmed as a final order on June 5, 2020, with respect to a workplace located at 2072 Grange Avenue in Highland Park, Illinois.
