Employees were able to access elevated work areas and observed working at height without the use of any personal fall protection or fall protective systems.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:   At a worksite located at 3027 NW Thoreau Dr, Lee's Summit, MO 64018: Employees were exposed to fall hazards. Employees were able to access elevated work areas and observed using extension ladders that were not extended at least 3 feet above the upper landing being accessed.

29 CFR  1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  At a worksite located at 3027 NW Thoreau Dr, Lee's Summit, MO 64018: Employees were exposed to fall hazards. Employees were able to climb a stair rail leading to the second floor without the protection of a stairrail system to protect employees from unprotected sides and edges.  Urbina General Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1052(c)(1)(ii), which was contained in OSHA inspection number 1521484, citation number 1, item number 2 and was affirmed as a final order on July 14, 2021, with respect to a workplace located at 2 Dakota Circle, Lake Winnebago, MO 64034.

The employee was using a step ladder in the closed position and not as the manufacturer had intended, which is fully locked out and open.  Urbina General Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1052(c)(1)(ii), which was contained in OSHA inspection number 1479599, citation number 1, item number 2 and was affirmed as a final order on July 24, 2020, with respect to a workplace located at 15900 W 96th St, Lenexa, KS 66227.
