Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:  fall and struck by hazards associated with not maintaining a safe distance from obstructions during operation of an aerial lift:  (a)  During tree removal:   On or prior to 10/21/21, an employee operating an Altec LRV60 forestry bucket truck was exposed to fall and struck by hazards when the boom of the lift contacted and became lodged on an obstruction (tree).

29 CFR  1910.67(c)(2)(v):  A body belt was not worn and lanyard was not attached to the boom or basket when working from an aerial lift.  (a) During tree removal:  On or prior to 10/21/21, an employee working from the bucket of an Altec LRV60 aerial lift was not wearing a body belt or fall arrest harness and was not attached to the boom or basket with a lanyard.

29 CFR  1910.133(a)(1):Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:  (a) During tree removal:   On or prior to 10/21/21, an employee was not wearing safety glasses or similar eye/face protection while operating a Stihl MS200 top-handle chainsaw in a bucket truck.  D & L Tree Service was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.133(a)(1), which was contained in OSHA inspection number 1421289, citation number 1, item number 2 and was affirmed as a final order on 12/20/2019, with respect to a workplace located at 1135 Erie Boulevard, Schenectady, NY 12305.
