29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Tapia Solution LLC, at a jobsite located at 3751 Mystic Way, Grove City, Ohio 43123: On and/or preceding October 20, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were applying siding to an existing single family house. The employees did not have any means of fall protection, thereby exposed to fall hazards up to 11 feet, 10 inches.

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access: a) Tapia Solution LLC, at a jobsite located at 3751 Mystic Way, Grove City, Ohio 43123: On and/or preceding October 20, 2021, the employer did not ensure that portable ladders used for access to an upper landing surface had side rails extend at least 3 feet above the upper landing surface being accessed. One extension ladder being used for access to the roof of a two story residential home were position with the side rails extended less than 13 inches beyond the upper landing. The following condition exposed employees to falls up to 11 feet.
