29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Tapia Solution LLC, at the jobsite located at 3785 Mystic way lot 135, Grove City, Ohio 43123: On and/or preceding March 2, 2022, employees were utilizing scaffolding while engaged in siding activities to a residential single family house. The employer failed to initiate and maintain fall protection program to address the identification or prevention of fall hazards.

Thereby exposing employees to  struck-by hazards to the eyes and face.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  e)  Tapia Solution LLC, at the jobsite located at 3785 Mystic way lot 135, Grove City, Ohio 43123: On and/or preceding March 2, 2022, the employer did not ensure employees engaged in siding activities to a residential single-family house while working from a pump jack scaffold were protected from falls. The Alum-A-pole pump-jack scaffold system was not equipped with an effective guardrail system, thereby exposing the employees to falls greater than 12 feet.

29 CFR  1926.1053(b)(4):Ladders shall be used only for the purpose for which they were designed.  a)  Tapia Solution LLC, at the jobsite located at 3785 Mystic way lot 135, Grove City, Ohio 43123: On and/or preceding March 2, 2022, the employer failed to ensure ladders were only used for the purpose for which they were designed. While engaged in siding activities, an employee positioned a metal platform on the end of a raised pump-jack scaffold and between the top rungs of a step ladder to access second-story fascia.
