29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about October 22, 2021, at a job site located on the Southwest corner of W. Ryan Rd & W. Loomis Rd. Franklin, WI, an  employee was working in a trench approximately twenty-two (22) feet deep without eye protection to protect the employee from  hazards such as falling or flying rocks, particles,  dirt, and related debris while removing an auger.

29 CFR  1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face:  (a) On or about October 22, 2021,  at the job site located on  the Southwest side corner of W. Ryan Rd & W. Loomis Rd. Franklin, WI,  an employee working  in the trench was exposed to struck-by hazards from falling rocks and dirt from the exposed  excavation face present on three (3) sides of the trench. This loose material  was not properly supported, or barricaded in a manner that would protect exposed employees working in the trench.

29 CFR  1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, or other hazardous conditions.  (a) On or about October 22, 2021,  at the Southwest corner of W. Ryan Rd & W. Loomis Rd. Franklin, WI, the employer did not insure the competent person was conducting inspection of the approximately 22 foot deep excavation prior to the start of work, and as needed throughout the shift to protect exposed employees from  struck by, engulfment, and asphyxiation hazards.

29 CFR  1926.652(e)(2)(i): Excavation of material to a level greater than 2 feet (.61m) below the bottom of the members of a support system was permitted where the system was not designed to resist the forces calculated for the full depth of the trench.  a) On or about October 22, 2021, at a job site located on  the Southwest corner of W. Ryan Rd & W. Loomis Rd. Franklin, WI,  an employee worked in a trench that was excavated to a depth of  approximately five (5) feet  below the trench box and shielding . This exposed the employee to a cave-in, engulfment and struck-by hazard.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  (a) On, or about October 22, 2021, at a worksite located at the Southwest corner of W. Ryan Rd & W. Loomis Rd., Franklin WI, an employee was conducting horizontal boring, related to water line installation while working in an unprotected portion of an excavation greater than twenty-two (22) feet in depth without  sufficient shoring or sloping. This exposed employees to a trench collapse and engulfment hazard from soil.  S.J. Louis Construction, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1356045, citation number 2, item number 1(a) and was affirmed as a final order on January 21, 2019, with respect to a workplace located at 1908 South Dakota Highway 50, Yankton, SD 57078.
