29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, are not protected by protective helmets. On or about October 25, 2021 at a worksite located on the south side easement of Prairie Village Dr, west of N Kelly Ave. Employees working inside the trench did not wear protective helmets (hard hats) to protect them from struck-by hazards.

29 CFR 1926.651(j)(2): Employees are not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about October 25, 2021 at a worksite located on the south side easement of Prairie Village Dr, west of N Kelly Ave, loose soil brought out of the trench, other materials, and other items were within 2 (two) feet from the trench opening, exposing employees inside the trench to struck-by hazards.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about October 25, 2021 at a worksite located on the south side easement of Prairie Village Dr, west of N Kelly Ave. Employees did not have a safe means of egress from a trench with a depth greater than 4 (four) feet, exposing the employees to struck-by and fall hazards. Davenport Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1201258, citation number 1, item number 1 and was affirmed as a final order on March 3, 2017, with respect to a worksite located at 3101 E. Memorial Rd., Edmond, OK 73013.
