29 CFR  1926.600(a)(6): All equipment covered by this subpart did not comply with the following requirements when working or being moved in the vicinity of power lines or energized transmitters, except where electrical distribution and transmission lines have been deenergized and visibly grounded at point of work or where insulating barriers, not a part of or an attachment to the equipment or machinery, have been erected to prevent physical contact with the lines:   (a) 520 Valentine Lane Bellefonte PA New Residential Homes- Employees were excavating a trench for utilities under an energized power lines that was 26000 volts phase to ground that was not deenergized, grounded or had an insulating barrier to prevent physical contact, exposing employees to electrical hazards, on or about October 25, 2021.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. -

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into physical or electrical contact with the electric power circuit:  (a) 520 Valentine Lane Bellefonte PA New Residential Homes- The employer did not ensure that the work was conducted in such a way that the Case 300-D excavator could not come in contact with the overhead power line, on or about October 25, 2021.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1926.600(a)(6)(iv): A person was not designated to observe clearance of the equipment and give timely warning for all operations where it is difficult for the operator to maintain the desired clearance by visual means:  (a) 520 Valentine Lane Bellefonte PA New Residential Homes- Employees were excavating a trench under energized power lines and did not designated an employee to observe clearance  from the power lines to the Case 300-D excavator, exposing employees to electrical hazards, on or about October 25, 2021.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
