29 CFR 1910.178(m)(5)(ii):A powered industrial truck is unattended when the operator is 25 ft. or more away from the vehicle which remains in his view, or whenever the operator leaves the vehicle and it is not in his view. On or about October 27, 2021 and times prior there to, the employer did not ensure powered industrial trucks were not being left unattended and powered on while the operator was out of view and/or more than 25 feet away from the machine at the following instances: a) Toyota Forklift and Stand Up Lift unattended, out of view of operator, near the Warehouse Office; b) Toyota Forklift unattended, out of view and distance, near Bay Door 7; c) Toyota Forklift unattended, out of view, near Bay Door 8.
