29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction located on Lot #7 Lauritsen Way, Newnan, GA 30265, Lower front and rear roofs: The employer exposed employees to fall hazards of approximately 10-feet to the lower level, in that complete fall protection systems were not provided to employees installing roofing underlayment on a 4/12 pitched roof. b) New residential construction located on Lot #7 Lauritsen Way, Newnan, GA 30265, Upper rear roof: The employer exposed employees to fall hazards of approximately 19-feet, 5-inches to the lower ground level, in that fall protection was not provided to employees engaged in roofing activities, including the installation of roofing underlayment on a 6/12 pitched roof. Jose Alejandro Hernandez Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1528422, citation number 1, item number 2 and was affirmed as a final order on 07/01/2021, with respect to a workplace located at (Lot #46) White Spruce Way, Newnan, GA 30265.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) New residential construction located on Lot #7 Lauritsen Way, Newnan, GA 30265, Rear lower roof: The employer exposed employees to fall hazards of approximately 10-feet to the lower level, in that the ladder side rails did not extend at least 3-feet past the roof landing to allow for safe access on and off the roof. Jose Alejandro Hernandez Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1528422, citation number 1, item number 3 and was affirmed as a final order on 07/01/2021, with respect to a workplace located at (Lot #46) White Spruce Way, Newnan, GA 30265.
