29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   Fabrication Shop  On or about November 17, 2021, the employer did not develop and implement a hearing conservation program for employees exposed to noise levels exceeding the OSHA action level of 85 decibels for an 8 hour time weighted average while operating the hand grinder and router in the fabrication shop. The employee was exposed to noise level at 95.1% dose which is above the action level of 50% dose (85 dBA) during the 366 minute sampling period. The equivalent level of the 95.1% dose is 91.5 dBA for an 8 hour Time weighted Average (TWA).
