OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   On or about October 29, 2021, employees engaged in warehousing activities are exposed to crushing hazards when operating forklifts without using the provided seat belt, or other means of restraint, to ensure they remain safely inside the operator's compartment in the event of sudden unexpected motion. The employer did not ensure that forklift operator restraint devices or seat belts were used.
