29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) New residential construction; Lot 155; top plate:  On or about 10/13/2021, and at times prior, the employer exposed framing employees to struck-by hazards , in that they are operating a Pneutools 3-1/4 strip nail gun at 140 PSI  without eye protection.

29 CFR  1926.302(b)(5):The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings were exceeded.  (a) New residential construction; Lot  155; Top plate : On or about 10/13/2021, and at times prior, the employer exposed framing employees to struck-by hazards , in that they are operating a pneumatic Pneutools 3 1/4 inch strip Nail Gun at 140 PSI . The operating air pressure for this tool is between 70-120PSI.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction; Lot 155; Top plate:  On or about 10/13/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were conducting framing activities and walking on the top plate at heights measured at 13 feet 5 inches to the lower level.
