29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about November 3, 2021, an employee was on a residential roof with an 8:12 pitch measuring the chimney for new siding installation, was not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 11 feet.

29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service: (a) On or about November 3, 2021, an employee was measuring the chimney to install siding. The employer did not ensure that the employee(s) personal fall arrest system was inspected and removed from service when damage/deterioration was noted. The shock pack on the lanyard of the employees personal fall arrest system had been duct taped together due to damage to the shock packs outer/protective housing.

(a) On or about November 3, 2021, an employee was measuring the chimney to install siding on a residential property. The employer did not ensure that employees exposed to potential fall hazards had been properly trained to recognize and minimize the fall hazards associated with their work.
