29 CFR  1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k):  a) Production Area:  An employee operating the notcher machine was exposed to 86.77% of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 88.9 dBA during the 136 minute sampling period on November 10, 2021. The exposure calculation included a zero increment for the 344 minutes not sampled. The employer has not provided the employee with training on the hazards associated with high levels of noise.   b) Production Area: An employee operating the ripsaw was exposed to 94.07% of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 89.5 dBA during the 419 minute sampling period on November 10, 2021. The exposure calculation included a zero increment for the 61 minutes not sampled. The employer has not provided the employee with training on the hazards associated with high levels of noise.   c) Production Area:  An employee operating the nail gun was exposed to 164.3% of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 93.5 dBA during the 415 minute sampling period on November 10, 2021. The exposure calculation included a zero increment for the 65 minutes not sampled. The employer has not provided the employee with training on the hazards associated with high levels of noise.   d) Production Area: An employee operating the nail gun was exposed to 148.9% of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 92.8 dBA during the 294 minute sampling period on November 10, 2021. The exposure calculation included a zero increment for the 186 minutes not sampled. The employer has not provided the employee with training on the hazards associated with high levels of noise.   e) Production Area:  An employee operating the nail gun was exposed to 147.1% of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 92.7 dBA during the 410 minute sampling period on November 10, 2021. The exposure calculation included a zero increment for the 70 minutes not sampled. The employer has not provided the employee with training on the hazards associated with high levels of noise.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) Throughout the establishment:  On or about November 3, 2021, and at times prior, the employer exposed employees to struck-by hazards, in that the employer did not provide forklift operators with training, or an evaluation of prior training provided to employees by previous employers, to ensure competency where employees operate forklifts including, but not limited to, the "Hangcha" model CPCD30-XW97F (serial number A5BJ21), "Hangcha" model CPCD50-XXW5BB (serial number E9BJ00534), "Hyundai" model 25D-7A (serial number HHIHHN02AA0000778), "Toyota" model  7FDU30 (serial number 60106) and "Hyundai" model 25L-7A.

29 CFR  1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a) Throughout the establishment:   On or about November 10, 2021, and at times prior, the employer exposed employees to respiratory hazards, in that the advisory information contained in Appendix D of the respiratory standard was not provided to employees who were provided with and wore "Gateway" 80101 N-95 filtering facepiece respirators on a voluntary basis.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Production Area:  On or about November 10, 2021, and at times prior, the employer exposed employees to chemical hazards, in that training was not provided to employees that use chemicals, such as, but not limited to, propane, diesel fuel, spray paint and  EZFit Air Tool Oil.
