On or about November 2, 2021 and times prior there to, the employer did not ensure a ladder being used by employees to access an upper working surface had the cleats placed properly and parallel to the ground.

29 CFR  1926.1053(b)(16):Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  On or about November 2, 2021 and times prior there to, the employer did not ensure ladders used by employees at the job site were free of structural defects such as damaged rails and defective components in the following instances:  a) Ladder on South Side of home had side rail damage b) Ladder in back yard of home had defective structural components.

On or about November 2, 2021 and times prior there to, the employer did not ensure employees performing roofing activities more than six feet above the lower level were provided with fall protection.  Alejandro Amaya Sandoval was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1475648, citation number 001, item number 002, issued on June 5, 2020, and was affirmed as a final order on July, 7, 2020, with respect to a workplace located at 6613 Barnes Road, Frisco, TX.

On or about November 2, 2021 and times prior there to, the employer did not ensure portable ladders used to access the roof extended at least three feet above the upper landing at the following instances:  a) Ladder near the front door entrance of the home b) Ladder on the South Side of the home c) Ladder in the back yard of the home  Alejandro Amaya Sandoval was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1475648, citation number 001, item number 003, issued on June 5, 2020, and was affirmed as a final order on July, 7, 2020, with respect to a workplace located at 6613 Barnes Road, Frisco, TX.
